ZAMAH — Terms of Service

Effective date: 8 July 2026

These Terms of Service ("Terms") are a binding agreement between you and Jared Newton, operating as ZAMAH ("ZAMAH", "we", "us"), of Ruimsig Athletics Stadium, Roodepoort, Gauteng, South Africa, governing your use of the ZAMAH mobile application and related services (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, Subscription Terms, and AI Use & Disclosure Notice, which are incorporated by reference. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. By using it you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You are responsible for your account and for keeping your credentials secure, and for activity under your account. Notify us of any unauthorized use at jarednewton07@gmail.com.

3. License to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial learning. You may not: (a) copy, modify, reverse-engineer, decompile, or create derivative works of the Service except as permitted by law; (b) resell, rent, or commercially exploit the Service; (c) access it through automated means or scrape it; (d) circumvent security, entitlement, or usage limits; (e) use it unlawfully or to infringe others' rights.

4. Intellectual property

The Service — including its software, content, coaching material, questions, scenarios, designs, trademarks, and the "ZAMAH" name and logo — is owned by us or our licensors and protected by law. Except for the license above, no rights are granted to you. Feedback you give us may be used by us without obligation to you.

5. Your content and data

You retain ownership of information you submit. You grant us a license to use your data solely to operate, secure, and improve the Service as described in the Privacy Policy. Your learning data is used to personalize your experience.

6. Subscriptions and payments

Paid features ("ZAMAH Pro") are offered as auto-renewing subscriptions sold and processed through Google Play and the Apple App Store. Pricing, renewal, free-trial, and cancellation terms are set out in our Subscription Terms and shown to you before you purchase. Payments, billing, and refunds are handled by the applicable app store under its terms — we do not process payments or issue refunds directly.

7. Educational purpose — not professional advice

ZAMAH is an educational and entertainment product designed to help you learn and improve at cricket. It is not professional coaching, medical, physiotherapy, fitness, or health advice, and it does not guarantee any particular improvement, result, selection, or performance outcome. Always use appropriate supervision and safety when practicing any physical activity, and consult a qualified professional (coach, physician) before beginning any physical training program.

8. AI-assisted features

Certain features use algorithmic and/or AI-based personalization and coaching. AI-generated feedback may be imperfect or incomplete. See our AI Use & Disclosure Notice. You should not rely on AI-generated content as a sole source of truth.

9. Availability, changes, and beta features

We may modify, suspend, or discontinue any part of the Service, and may offer beta or experimental features "as is." We aim for high availability but do not guarantee uninterrupted or error-free operation.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or for legal, security, or operational reasons. Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability, governing law) will survive.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Nothing in these Terms excludes or limits rights you have that cannot be excluded under the South African Consumer Protection Act, 2008 or other applicable law.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAMAH AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 100. This clause does not limit liability that cannot be limited by law (including under the South African Consumer Protection Act), or for death or personal injury caused by our negligence, fraud, or wilful misconduct.

13. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service or breach of these Terms, to the extent permitted by law.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-laws rules. You and we submit to the jurisdiction of the courts of Gauteng, South Africa (Johannesburg), unless mandatory local consumer law in your country of residence provides otherwise. Nothing here removes non-waivable rights you have under your local consumer law.

15. Apple / Google specific terms

If you obtained the app from the Apple App Store, the Apple Standard EULA and Apple's third-party-beneficiary terms also apply, and Apple is not responsible for the app or any claims relating to it. If from Google Play, the Google Play Terms of Service also apply. Where these Terms conflict with a store's required terms for that store's users, the store's required terms control for that distribution.

16. Changes to these Terms

We may update these Terms. Material changes will be notified in-app or by email; continued use after they take effect is acceptance.
